Online gambling – Ukraine

In May 2009, a fire broke out in a Metro Jack Pot casino in the eastern Ukrainian city of Dnipropetrovsk. 9 were killed and 11 were seriously injured in the conflagration. As a direct measure after the incident, all casinos, gambling halls, and night clubs were shut down in the city until they could be checked for safety. Later that year, the moral outrage against gambling sparked by the incident grew so large, that all gambling facilities were banned in the country on account of the events in Dnipropetrovsk.

The 2009 law, called “On Prohibition of Gambling Business in Ukraine” or Gambling Ban Law prohibited all gambling operations within the country, except the lottery, which is a state monopoly. Many protested against the provision, as Ukraine had a blossoming gambling sector which provided employment for many thousands. Despite the opposition, the legislation was signed into law on June 23 by President Viktor Yushchenko.

On January 6, 2010 the Cabinet of Ministers excluded gambling from the list of economic activities, which can be licensed in the country – the ban was official.

Strangely enough, given that a fire in a land-based casino started the chain of events resulting in the ban, the law prohibited operating online casinos in the country as well. However, because of a loophole in the original legislation, providers could simply move their servers abroad and offer their services to Ukrainian players from there. The law was amended in 2011 to address this flaw, so from then on, all forms of gambling – online and offline – (except the state run lottery and offline poker) are banned in Ukraine.

However, this dry season just might come to an end this year, as conference* was organised in Kiev in 2015 October on the prospects of re-legalising gambling in the country in an improved and more controlled legal framework. It’s yet to be decided what the new legislation will look like, but a draft law published in 2010 suggests a regulated legal environment for gambling establishments in Ukraine much like its eastern neighbor, Russia. The draft should’ve been signed into law in some form by now, but the country is quite preoccupied with Crimea, so it was postponed indefinitely.

The draft law would require the establishment of the state-owned National Gambling Operator that would control the organisation and regulation of gambling activities and also issue licenses for all private gambling operators. According to the draft, gambling facilities could only be located in Gaming Zones which include for example 4-5 star hotels with more than 100 rooms and Ukraine registered ships with a casino of more than 500 sq. meters*. Re-legalisation of gambling will lift the ban on online operators as well.

In the meantime some foreign gambling websites accept players from Ukraine, and players who play o such websites are not prosecuted.

The law defines gambling as “any game that requires the player to make a bet that enables them to receive a prize, and the result of which depends on chance partially or completely“. This means, bingo falls within the scope of the ban.

Moreover, bingo in Ukraine, as in most of Eastern Europe is not really popular. Even if there were bingo clubs in the country, they were closed down after 2009 just like the rest of the gambling establishments.

Online bingo is technically illegal just the same, however, individual players are not prosecuted for playing on foreign platforms, nd such websites are not blocked.

Online Poker in Ukraine: illegal, players are not prosecuted

 

To stop poker from becoming a means of circumventing the gambling ban of 2009, the Ukrainian Justice Ministry removed poker from the list of legitimate sports and classified it as gambling.

However, the Ukrainian Poker Federation of Sport and the Ukrainian Poker Federation appealed the decision, and in 2013 the appeal court ruled, that poker is indeed a sport. Although the Ministry of Justice still has a chance to file a further appeal, some poker clubs are again operational in the country.

Online poker is still banned technically (although given that offline poker was legalized, this could be appealed), but some foreign operators accept players from Ukraine and players are not prosecuted by the government for playing poker online.

The first attempt of the Ukrainian government to regulate gambling dates back to 2003. However, the legislation that was passed then, called “On Gambling Games in Ukraine” did not include sports betting for some reason.
