Land based and online casinos in Sweden are legal, regulated and licensed by the state as well as all other forms of gambling, both online and offline. The two pieces of legislation that provide the legal framework for controlling and regulating gambling in Sweden are the Lotteries Act of 1994 and the Casinos Act of 1999*. The acts state, that only licensed operators are allowed to offer their services on the Swedish market.

However, in reality there is only one legal provider that reigns supreme over the Swedish gambling market, the state-backed company Svenska Spel. So while the legislation give the impression of a regulated but open market, the only company to have received a gaming license so far in Sweden is Svenska Spel, which practically has a monopoly over nearly all legal gambling operations in the country. This directly opposes the EU’s directive of gambling market liberalization and harmonization across members states. The situation will likely change in the near future.*

In 2002, the lotteries act was amended to allow Svenska Spel to offer its lottery games online and just four years later, in 2006 they got a green light for establishing an online poker platform as well. The poker site of Svenska Spel garnered an estimated market share of 22% in just three months**.

There were many concerns in the past decade regarding, whether the monopolistic position of Svenska Spel is in line with European free trade statutes. The basic argument of the Swedish state is that the monopoly of the company is proportionate and it serves the benefit of the players by protecting them from malicious platforms and helping to alleviate the potential social harms caused by gambling.

Although, the Swedish laws do not criminalise players who play in foreign online casinos, nor does the government order ISPs to block foreign sites, but unlicensed operators are prohibited from advertising on the Swedish market, and these laws are properly enforced. Newspapers were fined for displaying ads of unlicensed online gambling sites in the country on several occasions in the past years***.

However, last year the European Commission announced, that it will take the Swedish online gambling laws before the European Court of Justice, as the Commission determined, that the laws are primarily designed to protect the state-owned Svenska Spel’s gambling monopoly – basically addressing the elephant in the room.

As a result of these provisions, Sweden’s Ministry of Finance finally announced, that it will launch an inquiry to discover the possibilities of a more open online gambling landscape in Sweden.
